Charges against Pellizotti have been dropped. He's a free man and is been punished for one year, without prosecution. After Valjavec the second rider who's been put on inactive but where no charges has been charged.
Strange case.. Irregularities in his blood passport caused the whole scene.. Without getting consequences out of it agaian.. Is it the end of the blood passport?
And where is Pellizotti going to ride next year.. If Androni may ride the Tour and Vuelta I know one team who's searching for a GT-man.. Also VacansOleil will be keen to sign him.. And what about Liquigas where their credo is: More GT is better! Or.. Is this Riis' plan B?
Questions.. Too bad some of the questions, UCI will not answer.. But we have.. again another soap n cycling world..

Ooh will ask one more thing.. Valjavec was innocent.. Or so we must believe.. Why didn;t he shout out against the system.. Or why didn't the cycling world that? And is this case going to tie the room together?

I think it’s time to start a count-down clock for the demise, or, at the very least, the near-total restructuring, of the UCI.

The UCI will have to take the passport cases all the way.

To have two case of Irregularities in the passport go against the UCI, could transform the passport tool from being used as evidence to simply being an indicator of who to conduct more tests on. Such a transformation could set the fight against doping many stapes back imo.

Note: not defending UCI here, just pointing out the potential implications.

Yeah, this will go further.

UCI found there was reason to call for a ban; CONI agreed and suggested two years; TNA disagreed and let him off. I expect either the UCI or CONI (or both) will take it to CAS—especially since Pellizotti is saying he’ll seek damages.

Incidentally, where's gav?

I need her to explain the relationship between CONI and TNA (pretty please with cupcakes on top?)—some articles talk about them as if they’re separate, and some say TNA is part of CONI. Since at least some sources suggest they differed in opinion on Pellizotti, I’m wondering how it all works in Italy?

I remember a CAS case

Where CONI’s anti-doping office appealed a TNA decision, and it sounded very much like it was CONI against CONI.

Thanks for that--it's getting clearer.

TNA is part of CONI (“CONI National Anti-Doping Tribunal”), but since they’re independent, CONI can take them to CAS if they disagree with a verdict.

I found this (Google-translated) on CONI’s page:

The national Court of Arbitration for Sport has set up at the Italian National Olympic Committee (CONI), in full autonomy and independence, in accordance with Articles 12 and 12 ter of the Statute and administers the arbitration and the proper and expeditious conduct of arbitration proceedings as provided for in the Code of proceedings before the national Court of Arbitration for Sport and Discipline of the arbitrators.
So it looks like it’s under CONI, but fully independent?

Now I could say something profound and important about the bio passport here, but I have a personal grievance: VDS!

Now I spent 18 futile points on Pellizotti. How close might I have got to tgartner if Pelli had been able to race?! The suspension was all for NOTHING! NOTHING I tell you! I have been robbed of points! Bah!

We will never know.

Pelli may have won the Giro (hypothetically) and Nibali podiumed at the Tour, which he was going to ride initially. I stick to my guns…I was ROBBED! ;)

Ah, but the thing is...

There’s so much more to VDS than picking riders who can climb, sprint, or break away. You also have to pick riders with the ability to avoid being falsely accused by the UCI. I’m almost sure that’s why I passed over Pellizotti.

Or it could have been blind luck.

It may be a language thing but Pellizzotti has been prosecuted and he has been charged with a doping violation. It’s not as if they’ve just been letting him stay suspended without trial.

It's a big difference between charged and convicted though...

In this case, to me, it seems that they have given up on trying to proceed, right? If so, then this is a big black eye.

Indeed, it's not like anyone has determined Pellizotti was innocent.

Just this one panel has decided the evidence wasn’t sufficient for a guilty verdict.

I'm not a vengeful person, but if I was Pellizotti, I'd be one royally pissed off curly haired dude about now...

I’d sue the living hell out of the UCI – loss of wages, defamation of character, marketing image is slandered, not to mention the personal issues that have to come up from being told to sit and wait and then now hear, um, yeah, you can race again…cough cough…

“If the passport doesn’t fit, you must acquit!” (but even that snark doesn’t get to it. UCI big time FAIL!!!)

Is there a bio passport contract?

Or similar, saying “we’re going to take samples from you to see if you’re doping, you’re OK with this or gtfo”. If there is, I don’t see how Pellizotti can successfullu sue UCI.

The passport may not be enough to convict for borderline cases, but that doesn't mean it's not a great tool against doping

It can still be used to target rider for additional testing. And it is still a deterrent for egregious doping.

I think a tool that makes people “dope less” is still a good tool. Hopefully, with time, the amount of doping people will be able to get away it won’t be worth it.

Let get it straight. TNA suspended De Bonis and Cauccioli for Passport irregularities, and then acquitted Pellizotti for same offence.

Maybe they know something we don’t know?

I used to be a big fan of the Racer Formerly Known as Bert! But then again, I used to believe in Santa ,Tooth Fairy and innocence of Floyd!

But I disagree with what Phil typed—maybe not with what he meant depending on the snark level . . .

In a battle between the UCI and ASO . . . the UCI . . . it is becoming painfully apparent . . . has no compelling power that couldn’t be quickly replicated within a month or so by a schismatic organizing body.

That’s probably an extreme statement, but with every week that passes the UCI are providing multiple examples of why they are not fit to run the anti-doping programs.

With every week that goes by they provide examples of why they cannot control team eligibility for races—or provide meaningful regulations for rider contracts and transfers.

What do they do well again?

I think that would be terrible for the sport

UCI does a lot more than the top 20 or so road races. It’s like an iceberg, pro cycling is just the tip.

Keep the organization, ditch the management. Restructure a bit.

UCI and amateur cycling works well enough.

   UCI and testing and promoting professionals is what is broken. A totally independent organization for the pro’s is what is needed.

The thing is, I don't wan to be a cynical bastard but..

I was starting to believe in the Biological passport
I was starting to believe in organizations like Bike Pure and their riders
I was starting to believe…that we’re making progress (to what exactly I’m not always sure) but ultimately a sport where riders don’t feel that doping is bringing them any significant value.

The last 4 weeks have completely fractured that belief.

I feel like it’s 1998, 2003, 2004, 2005 all over again.

I just, AGAIN, don’t have enough faith in “the word of the rider”, and now I’ve lost faith, AGAIN, in the governing bodies.

Yes, what we need in the center of this wall is a little Italian flare. I’m thinking Franco Pellizotti to play off of Ivan Basso. Ivan has the prettier face but it’s a little conservative, and sadly, I think he might actually be straight. But Honey wait till you see what I have picked out for the centerpiece.
