does California have a law that makes the other racers jointly responsibly for the killing?
Sort of like the felony homicide rule, only something that would apply in this case?
In my opinion they should all do time for vehicular homicide and a host of other charges related to racing. Street racing is a danger to everyone on the road and has no place in our society. These kids wanted to imitate Fast and the Furious, let’s see how they enjoy “playing” Oz ( by that I mean the HBO mini-series and the most gruesome depiction of prison I could think of, not the former penal colony of the same nickname).
Sad news about Alvarado though, RIP.
No arrests?
WTF?! All three drivers should have been arrested at the scene for manslaughter.
They will hunt you down in Florida.
They did that recently when it was one of the drivers racing was killed.
Bicycling is the nearest approximation I know to the flight of birds. Louis J. Helle, Jr.
From the second link above:
“They’ll complete their investigation which will take several weeks and then they’ll submit to the (District Attorney) for review, but they are confident that the DA will file criminal charges,” Beavers said.
There’s no such thing as ‘enough’ photos of Tom getting owned by Tony… makes me wanna lick the bitter tears from his cheeks--Lou...
No
I don’t think that racing/reckless driving would be a qualifying felony. In any event, I’ll bet against anyone thinking we’ll even see manslaughter charges here. Reckless endangerment, at most. And that’s just because it’s apparently established that there was racing involved. If the kid just took a flyer into the other lane and said he’d accidentally lost control? I’d bet against any charges at all.
oh I misunderstood
not all felonies apply.
sorry … Law & Order is the extent of my legal training

Question
no charges of any sort for accidentally losing control even if he’s speeding? The articles said he was doing 70. Unless he was on an interstate (which seems unlikely, since bikes aren’t permitted on interstates), he was doing at least 15 mph over the limit…
oh, I'm sure
he’ll get a ticket of some sort. I just don’t think it will be directly related to Alvarado’s death. I started paying closer attention to accidents and final charges/outcomes a couple of years ago, after the Alice Swanson case. At this point? I kind of wish I hadn’t. The almost complete lack of interest in taking cyclists’ deaths seriously is deeply depressing. I’m not looking for vengeance, and I’m quite open to the argument that in some cases, having caused a death will be punishment enough. But you start seeing these situations where a cyclist is hit and dragged, no charges. Or hit because the driver was texting, no charges. Or any of a billion situations where a cyclist was killed because the driver couldn’t be bothered to pay attention. And the consequences? Just a dead cyclist. Too bad. Like deer on the road.
